First Conviction

A first D.U.I. offense is charged as a misdemeanor. If convicted, a defendant can face up to 1 year of jail and may pay a fine of between $600 and $2100. Second Conviction

This D.U.I offense will also be charged as a misdemeanor, however if the date of conviction is within 5 years after the first conviction, penalties will be enhanced. Jail time imposed will be no less than 5 days and no more than 1 year. In lieu of the 5 day mandatory jail term, the court may permit the defendant to perform 30 days of community service. The fine will be between $1,100 and $5,100. The defendant’s driver’s license will be suspended for 1 year and they must attend a court ordered treatment program.

Third Conviction

For this D.U.I. misdemeanor offense, the defendant will be ordered to jail between 60 days and 1 year. The fine will be between $2,100 and $10,100. The driver’s license will be revoked for 3 years and they must attend a court ordered treatment program.

Fourth Conviction

This D.U.I. defense is classified as a Class C felony. Jail time will be between 1 year and 1 day to 10 years. The fine is between $4,100 and $10,100. The driver’s license will be revoked for 5 years and they must attend a court approved treatment program.
